NSK Europe Privacy General Policy

This Policy describes the responsibilities, and at a high level, the processes to be followed to promote compliance with data protection laws for the Processing of Personal Data relating to EU Data Subjects, in particular taking into account the requirements set out in the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter collectively referred to as “GDPR”).

This Policy applies to NSK Europe and its subsidiaries and European affiliates in their capacity as Data Controllers and/or Data Processors, as applicable. It also applies to any other third party acting on behalf of NSK Europe, that collects or Processes Personal Data on behalf of NSK Europe.

Definitions in this Policy shall have the following meaning:

1.  Data Controller: the entity responsible for making decisions about what Personal Data is used and for what purposes

2.  Data Processor: an entity carrying out a function or service on behalf of a Data Controller.

3.  Data Subject: an individual about whom Personal Data is Processed.

4.  EEA: European Economic Area

5.  EU: European Union

6.  Data Protection Authority: means the local data protection authority, responsible for enforcing compliance with the GDPR.

7.  Personal Data: any information which identifies and relates to a living individual on its own, or when combined with other information held by the Data Controller.

8.  Processing (including Process, Processes and Processed): any action taken with Personal Data from collection to destruction, including use (whether passive or active, i.e. storage or reading on a screen), amendment, disclosure, transfer, retention etc.

9.  Special Categories of Data: Personal Data relating to mental health, race or ethnicity, political opinions, religious or philosophical beliefs, trade union membership, sexual life / preference and genetic and biometric data.

Under GDPR, criminal allegations and offence information is no longer considered as sensitive/special category it is instead generally prohibited to collect and Process such information without a legal requirement.

1. General principles

NSK Europe will adhere to the GDPR and any applicable European national law deviations from the GDPR.

NSK Europe will adhere to the following general principles in relation to the Processing of EU Personal Data:

1)        Processed lawfully, fairly and in a transparent manner (lawfulness, fairness and transparency);

2)        collected for specified, explicit and legitimate purposes only (purpose limitation);

3)        adequate, relevant and limited to what is necessary in relation to the purpose in 2) above (data minimization);

4)        accurate, and where necessary, kept up to date (accuracy);

5)        kept in a form which permits identification of EU Data Subjects for no longer than is necessary for the purposes for which the Personal Data is Processed (storage limitation); and

6)        Processed in a manner that ensures appropriate security of the EU Personal Data, including protection against unauthorized or unlawful Processing and against accidental loss, destruction or damage using appropriate technical or organizational measures (integrity and confidentiality).

Unless otherwise provided in the GDPR or other applicable laws, NSK Europe will endeavor to comply with the exercise of the following rights by EU Data Subjects:

1)      Portability

EU Data Subjects have the right to receive certain Personal Data or to transfer or have them transferred to another data controller in certain circumstances.

2)      Right to rectification

EU Data Subjects will have the right to obtain the rectification of inaccurate Personal Data from NSK Europe as Data Controller without undue delay.

3)      Right to erasure (“right to be forgotten) ”

In certain circumstances EU Data Subjects will have the right to obtain from NSK Europe as the Data Controller erasure of their Personal Data without undue delay.

4)      Right to restriction of Processing

EU Data Subjects will have the right to obtain from NSK Europe as the Data Controller restriction of Processing of their Personal Data without undue delay in certain circumstances.

5)      Subject access requests

EU Data Subjects have the right to request from NSK Europe as the Data Controller access to their Personal Data which is held about them.

2.    Data Protection by Design and by Default

NSK Europe will implement appropriate technical and organizational measures to comply with this Policy at the outset and during the Processing of EU Personal Data. Such measures could consist, inter alia, of minimizing the Processing of Personal Data, transparency with regard to the functions and Processing of Personal Data, enabling the Controller to create and improve security features.

3.    Transfer of EU Personal Data

Any transfers of EU Personal Data by NSK Europe to another NSK entity or other third party based outside of the European Economic Area (EEA) is only done where appropriate safeguards have been put in place. Such safeguards relevant to NSK Europe include: (i) putting in place the EU Model Contractual Clauses (also referred to as data transfer agreements); (ii) the Privacy Shield; (iii) appropriate Processing clauses in contracts; (iv) obtaining consent from EU Data Subjects where appropriate; and (v) where a decision of adequacy for a country based outside the EEA has been made by the European Commission.

4.    Records of Processing Activities

NSK Europe will maintain records of Processing activities under its responsibility to evidence compliance with Article 30 GDPR.

5.    Training

NSK Europe will provide initial training on data protection to new employees and regular training to existing employees.

6.    Compliance responsibility

All employees are responsible for supporting the principles contained herein, and complying with this Policy and working with fellow employees to continually monitor NSK Europe compliance with this Policy. Management serves as a role model for supporting these principles and is responsible for monitoring the level of compliance with this Policy within the area of their responsibility. In some countries, the management can be held personally liable for the company’s infringement of data privacy.

7.    Security

NSK Europe will ensure that appropriate security measures are taken against unlawful or otherwise unauthorized Processing of EU Personal Data, and against loss, corruption or damage to, EU Personal Data.

NSK Europe is responsible for ensuring that any Personal Data which it holds and for which it is responsible, is kept securely and is not under any conditions disclosed to any third party unless that third party has been specifically authorized by NSK Europe to receive that information and is safeguarding the Personal Data subject to one of the safeguards listed in point 3 above.

Compliance with data protection guidelines and the applicable data protection legislation is subject to regular data protection audits and other controls. The Data Protection Officer (where appointed) in a country is responsible for the implementation of the guidelines and for any other areas in the company having audit rights. Any appointed Data Protection Officer(s) is in a position to perform their duties and tasks in an independent manner.

Where a Data Protection Officer is not appointed, the tasks relating to data protection are performed by local data protection coordinators.

8.    Personal Data Breach

In the case of breach of EU Personal Data, NSK Europe as the Data Controller will notify such personal data breach to the appropriate European data protection supervisory authority within 72 hours of becoming aware of such personal data breach unless such breach is unlikely to result in a risk to the rights and freedoms of EU Data Subjects.

Where notification is not made within 72 hours (which is inclusive of any public holidays, or similar, and weekends), the later submitted notification will be accompanied by the reasons for any delay.

Where the personal data breach is likely to result in a high risk to the rights and freedoms of EU Data Subjects, NSK Europe as Data Controller will communicate the personal data breach to such Data Subjects without undue delay.

NSK Europe Privacy Policy for registering and attending a webinar or live broadcast event

This policy describes how collect, use and store your personal data in connection with registering for and attending a webinar or live broadcast event (an “Event”).  

In this policy, personal data means any information that relates to an identifiable natural person; in this case, you and is This policy is issued in compliance with the UK General Data Protection Regulation (UK GDPR), the EU General Data Protection Regulation (EU GDPR), and the Data Protection Act 2018.

You should read this policy, so you know what personal data we collect about you, what we do with it and how you can exercise your rights in connection with it. You should also read any other privacy policy that we give you, that might apply to our use of your personal data in specific circumstances from time to time. The NSK Europe Group (“Group”) is made up of different legal entities, details of which can be found in the “Further information” section below. This privacy policy is issued on behalf of the Group so when we mention "NSK", "we", "us" or "our" in this privacy policy, we are referring to the relevant company in the Group responsible for processing your data, who will be the data controller. For the purpose of this policy and the Event, the data controller is NSK Europe Limited with its seat in the UK.

To the extent two or more Group entities process your personal data in a joint manner, we kindly ask you to address any queries you may have to NSK Europe, whose details are set out at the end of this privacy policy. We will then forward your query to the NSK entity who is primarily responsible, if necessary.

As a controller we make decisions about how and why we use your personal data and, because of this, we are responsible for making sure it is used in accordance with applicable data protection laws. We are required by law to give you the information in this policy.

What types of personal data do we collect and where do we get it from?

We collect the following categories of personal data if you are an attendee or presenter at one of the Events:

›       Contact information: name and surname, e-mail address, telephone number, name of the company, address of the company, your job title, your preferred language, participant information (join/leave time);

›       If we record Events: your image and audio may be captured;

›       If we have a Q&A: if you interact with the Q&A, your comments may be published to others at the Event and will also form part of the recording.

What do we do with your personal data, and why?

We use your email address to provide you with the Event details. This will include information about any recording taking place. For recorded Events we may email you a link to the recording once the Event has concluded.

For some Events we may publish the recording (or part of it) on our website, and social media channels, these include but not limited to YouTube, LinkedIn, Instagram, Twitter and Facebook, so this is accessible to a wider audience. If an Event recording is to be published, we will always notify you before the Event.

We don’t publish delegate lists for Events but your name and email address may be visible to others in attendance during the Event.

Our purpose for collecting this information is so we can facilitate the Event and provide wider access to its content.

The lawful basis we rely on for processing your personal data is your consent under article 6(1)(a) of the UK GDPR/ GDPR and legitimate interest of Article 6(1)(f) of the UK GDPR/ GDPR. There could also be cases where we process personal data in connection with an Event to comply with a legal obligation to which we are subject (e.g., if we must retain certain personal data). If so then the lawful basis of processing will be legal obligations under article 6(1)(c) of the UK GDPR/GDPR.

For some processing activities, we consider more than one lawful basis to be relevant – depending on the circumstances.

We will inform you separately in case your personal data is subject to so-called automated decision-making. In such case we will also provide you with information as to the logic used by such systems. You have the right to object to being subject to such decisions, and/or challenge any decisions made wholly on the basis of any automated decision-making system, including providing any additional evidence to assist the individual reviewing the decision.

Automated decision-making within the meaning of Article 22 of the UK GDPR/ GDPR is not used.

Direct marketing

During the registration process for the Event when your personal data is collected, you will be asked to indicate your preferences for receiving direct marketing communications from the NSK group via email, SMS, telephone, post and social media.

You can ask us to stop sending you marketing communications at any time by following the opt-out links within any marketing communication sent to you or by contacting us info-uk@nsk.com

If you opt out of receiving marketing communications, you will still receive service-related communications that are essential for administrative of the Event.

How long is your personal data stored?

We will only retain your personal data for as long as necessary to fulfil the purposes outlined in this policy. We will normally retain your personal data for up to 12 months after the Event. After this period, your personal data will be securely erased unless you have opted to receive marketing communications, in which case your personal data will be retained until you withdraw your consent or until it is no longer needed. We may also retain your personal data where we are legally required to retain this information for longer.

Communication data of an Event (including user details, online metadata, and phone dial-in data) are stored by Microsoft Corporation beyond the end of the Event in accordance with the applicable legal rules. Further information on how the service providers deal with such data can be found for Microsoft Teams at https://privacy.microsoft.com/en-us/privacystatement.

Who else will have access to your personal data?

Other NSK companies

Personal data will only be shared inside the Group in the UK, EEA and outside the EEA, and we will take appropriate steps to ensure that Group personnel are bound by duties of confidentiality with respect to your personal data.

Service Providers

NSK Europe uses trusted third party service providers, including:

›       providers who assist in delivering the event, such as webinar hosting platforms including but not limited to Microsoft Teams

›       Social media platforms to publish the recordings of some Events

›       other service providers that NSK have retained to support in the setup or the follow up on the Event

Please note that these providers will drop non-essential cookies.

Where applicable, your personal data will be processed by the service provider on behalf of NSK Europe. NSK Europe will ensure that any third party that processes your personal data can provide sufficient guarantees regarding the confidentiality, security of your personal data and that they do not process your personal data for their own purposes.

We will also share personal data with law enforcement or other government authorities, if required by law or where reasonably necessary to protect the rights, property, and safety of others or ourselves.

Marketing- Third Parties

We will get your express consent before we share your personal data with any third party for their own direct marketing purposes. If you consent to third-party marketing, your data may be shared with marketing affiliates, event co-organisers, or promotional partners. Information regarding the identity of these third parties will be provided to you before you give us your consent.

Do we transfer your personal data overseas?

A transfer to third countries, both within the Group and by commissioning contract processors and third parties, cannot be ruled out completely when using Microsoft Teams. Information might be sent outside the UK or EEA to Microsoft’s data centres and when uploaded onto social media sites. Your personal data may be transferred to recipients in countries outside the UK or EEA, which may have a lower level of data protection.

We will only make transfers outside the UK or EEA if:

›       that country ensures an adequate level of protection for your personal data;

›       the recipient or recipient country is subject to an approved certification mechanism or code of conduct with binding and enforceable commitments which amount to appropriate safeguards for your personal data;

›       we have put in place appropriate safeguards to protect your personal data, such as a contract with the person or entity receiving your personal data which incorporates specific provisions as directed by the ICO or European Commission;

›       the transfer is permitted by applicable laws; or

›       you explicitly consent to the transfer.

What are your rights and how can you exercise them?

Where NSK Europe’s processing of your personal data is based solely upon your consent,  you have the right to withdraw your consent at any time. If you decide to withdraw your consent NSK will stop processing your personal data for that purpose. This will not impact on the legality of any processing undertaken by us prior to the withdrawal of your consent.

Where our processing of your personal data is based on legitimate interests, you can object to this processing at any time. If you do this, we will need to show either a compelling reason why our processing should continue, which overrides your interests, rights and freedoms or that the processing is necessary for us to establish, exercise or defend a legal claim.

Where we are processing your personal data for direct marketing purposes, you have the right to object to that processing.

You have also the right to:

  • request access your personal data and to be provided with certain information in relation to it, such as the purpose for which it is processed, the persons to whom it is disclosed and the period for which it will be stored;
  • require us to correct any inaccuracies in your personal data without undue delay;
  • require us to erase your personal data;
  • require us to restrict processing of your personal data;
  • request that we provide you with a copy of any personal data which you have provided to us, in a machine readable format, where we are processing it on the basis of your consent or because it is necessary for the performance of a contract between you and us where the processing is automated; and

2. Processing of your personal data

The NSK Europe hiring company will process your personal data for the purpose of the job recruitment and placement.   • Legitimate interest of NSK Europe or third parties: where on balance, NSK Europe’s lawful business reasons for processing are fair – these include statistical purposes, obtaining information from and about you and reviewing it to make informed decisions on recruitment and hire the most appropriate candidates (which includes checking your prior employment history), carrying out tests on you involving profiling (personality tests are used to give an insight into how you behave at work or how you like to be managed; aptitude tests are also used to assess your core skills, such as numeracy, written understanding, spatial awareness and logical reasoning) as well as establishment, exercise or defence of any legal claims;
  • Other obligations: where the processing is necessary for the purposes of carrying out the obligations and exercising specific rights of either you or NSK in the field of employment and social security and social protection law or where the processing is necessary for the purposes of preventive or occupational medicine, for the assessment of your working capacity, medical diagnosis, the provision of health or social care or treatment or the management of health or social care systems and services on the basis of legal obligations or pursuant to contract with a health professional who is under a professional obligation of confidentiality;
  • Consent: if you authorize us to keep your data for future positions (in which case the legal basis for such processing would be your consent, which you may withdraw at any time).

3. How does the NSK Europe hiring company obtain your personal data?

The personal data processed by the NSK Europe hiring company is mostly obtained via email and post sent by you. Other personal data about you is collected in the course of the recruitment process (during interviews or tests). Other types of personal data may also be obtained from identified third parties, legally allowed to provide such kind of information, including for example, authorized recruitment agencies or providers of tests.

4. How long is your personal data stored?

If your application for employment is successful NSK Europe will retain any personal data held as part of your application on your employment file for the duration of you employment and for some time after the end of your employment with us. For example NSK Europe Ltd. or its subsidiary established in the UK will retain such data normally for 7 years after the end of your employment.

If your application for employment is not successful, your personal data will be stored for the duration of the recruitment process up to the period specified below upon notification that your application was not successful for the purposes of the establishment, exercise or defense of any legal claims. If you consent, your personal data will be retained in our talent pool for a period as indicated in the consent form.

Storage periods for unsuccessful candidates:

Netherlands - 4 weeks

Spain - 1 year

Germany, France, UK and Italy - 7 months

Poland - 3 years

 

5. Who else will have access to your personal data?

Other NSK Europe hiring companies

Personal data will be shared with other NSK Europe companies, when for example the same IT department is working for both of them or your recruitment requires sign off from a manager employed by a different NSK Europe company. Your personal data may in particular be shared with NSK Europe Ltd. for storing and maintaining your personal data in its database.

Service Providers

The NSK Europe hiring companies uses third party service providers who provide technical and support services in connection with the application and recruitment process. Where applicable, your personal data will be processed by the service provider on behalf of the NSK Europe hiring company. The NSK Europe hiring company will ensure that any third party that processes your personal data on behalf of the NSK Europe hiring company has implemented appropriate measures designed to protect the confidentiality and security of your personal data.

Transfers outside the EEA

In limited circumstances your personal data may be shared with NSK companies outside the EEA area. NSK is committed to ensuring that there are adequate safeguards in place, as required by applicable laws, to protect the personal data that is transferred to countries that may not have adequate data protection laws. As part of this commitment, NSK have adopted an intracompany data transfer agreement incorporating EU Standard Contractual Clauses based on the model clauses prepared by the European Commission that applies to each of NSK entities. All mentioned companies will take appropriate steps to ensure that their personnel is bound by duties of confidentiality with respect to your personal data.

Disclosure to third parties

In certain circumstances, the NSK Europe hiring company shares or is obliged to share your personal data with third parties, for the purposes described above and in accordance with applicable data protection laws. These third parties will act as controllers of your personal data in their own right, and they will be responsible for compliance with applicable data protection laws.

These third parties are:

›       police, public prosecutors;

›       external advisors (such as legal advisors, accountants, auditors);

›       law enforcement bodies;

›       other statutory or governmental bodies;

›       the courts;

›       other statutory regulators;

›       to any other third party that we are required by law to provide information to.

 

6. What are your rights?
Where NSK Europe’s processing of your personal data is based solely upon your consent, you have the right to withdraw your consent at any time. If you decide to withdraw your consent NSK Europe will stop processing your personal data for that purpose. This will not impact on the legality of any processing undertaken by us prior to the withdrawal of your consent.

You also have the right to request access to your personal data, the right to rectification of inaccurate personal data, the right to deletion, the right to limit the processing, and the right to data portability. You are also entitled to object to the processing of your personal data in certain situations.

The abovementioned rights lapse upon your death. However, you may define guidelines on the retention, erasure and disclosure of your personal data after your death. In any event, your heirs may exercise the rights mentioned in Section 6 after your death, to the extent necessary: to the organization and settlement of the deceased's estate; for the data controllers to take account of the death.
